During the court hearing dated 08/08/2024, Aryavat Foundation counsel prima facie pointed out that Coromandel International Limited Company operated without CC. It has been a big mistake. As per order dated 20.10.2021, the first application for grant of CC&A was rejected. was taken out, while the application for renewal was also rejected by the GPCB Board. Aryavat Foundation’s counsel has raised the question that,

*CC&A cannot be retroactively reviewed once rejected. Which is a legal issue*

Due to the prima facie reasons of the Aryavat Foundation lawyer, the GPCB lawyer has sought ten days time to file an affidavit to rebut the Aryavat Foundation. The court has fixed date 20/09/2024 for the next consideration of the matter. Also, Ashok Mohan Chauhan Environmental Engineer of Gujarat Pollution Control Board presented an affidavit before the National Green Tribunal.
Dt. Applied for renewal of CCA on 11.10.2021 which was rejected by GPCB Board on 29.07.2022 and Environment (Protection) on 30.07.2022 for violation of Hazardous and Other Waste (Management and Transboundary Movement) Rules, 2016. ) Act, 1986 under Section 5 of the Coromandel Project Notice was issued. Coromandel International Limited Company re-applied for CCA renewal on 21.08.2022. GPCB Board dt.
The application was rejected on 4/08/2023. Thereafter Coromandel International Limited again applied for CCA renewal on 11/08/2023 and the request for renewal of CCA was finally approved by the GPCB Board on 03/10/2023. came, and the CCA has been renewed till 30.09.2026. During this period the manufacturing activity continued, which is totally illegal on the part of Coromandel International Limited Company. And further, such illegal production activity has caused heavy pollution. During which the petitioner’s application for renewal of CCA remained pending with the Board for consideration. For this the Board has recovered Rs.11,70,000/ as compensation for environmental damage from Coromandel International Limited Company.
